If my name is mis-spelled on the court papers does this affect the validity of the IVA and mean I don't need to pay it?
I was put into an IVA in the county court but the company spelt my name wrong. The middle letter of my name was spelled with a Q rather than a G. Does this affect the legality of the arrangement and mean I do not need to pay it? If the arrangement is in my sole name is my wife obliged to help pay it?
I'm sorry to have to tell you that the answer to both of your questions is no. The first is a trivial error which could be corrected by the court as you are certainly a party to the case and similar mistakes happen regularly without any recourse. If you don't pay the court will make you bankrupt and you will lose the money you have put in.
The second is straightforward. The IVA is in your name and is ultimately your responsibility. Your wife can only be party to your debts unless they are joint accounts (when she would be jointly and severally liable). This would not be the case for example with credit card debts if she was merely an additional cardholder.
