A friend maxed out my husband's credit card, how can we get him to pay the money back?
A friend borrowed my husband's credit card, he had the pin number and maxed out the limit. My husband and he had a verbal agreement that this friend would pay back the money he owed as soon as possible but he failed to do so. Is there anything we can do to encourage him to repay us, since due to missed payments we got into considerable debt?
You could sue the friend for the debt. You will need to persuade the Court that there was an agreement that this person would pay you back. The lack of a written agreement may cause evidential difficulties as will the unusual nature of the agreement that you reached. The threat of legal proceedings (which should be brought in the County Court) may help make any letter you send carry more weight, particularly if you threaten to sue in say 14 days. If you do however you should issue a County court summons as soon as the 14 days have expired, or your friend may think your threats are simply "hot air".
